JBCC Edition 6.2

Overview

The course primarily focuses on the application of standard-form building and civil works contracts, with particular emphasis on the 2018 JBCC Principal Building Agreement (including the Nominated Selected Subcontract Agreement) version 6.2, alongside reference to the JBCC Preliminaries. A key theme throughout the course is the proactive approach of dispute avoidance rather than dispute resolution. Additionally, it provides an in-depth exploration of the roles and responsibilities of the project team, offering detailed insights into their functions within the contract framework, with cross-references to the other CIDB accepted standard forms of contract.

  • To deal with breaches of contract or with defective work
  • To terminate the contract, if required
  • To manage the taking-over of the works
  • To notify and/or resolve ‘disputes’

Program Outline

  • The course is structured in eight sessions over two days including ‘inception’ | ‘contracts’ | insurance | securities | execution | completion | claims | disputes.
  • The course is inter-active - time is allocated for questions about the subject matter and/or to discuss delegates’ problems encountered in practice.
  • Reference is made to relevant project management principles {PMBOK};
  • Reference is made to the appointment of professional team members (PROCSA) including the role of the contract administrator (in FIDIC, GCC, JBCC and NEC), the difference between the functions of the principal agent and the principal consultant.
  • Background information is provided to each set of clauses dealing with the legal precedent or historic reasons, their practical application and consequences on failure thereof.
  • Reference is made to corresponding clauses in FIDIC, GCC and/or NEC to avoid confusion.
  • Use and advantages of JBCC Published forms – certificates, securities, etc
  • Discussion - why the State has unique contract requirements.
