New practices notes were developed in response to As reported previously CESA has made extensive
needs expressed by members, including for example input to the revision of the OHS Construction
one explaining the rationale and methodology of Regulations and served on the task team created for
the new ECSA Guideline Fees format. Others were this purpose. The Department of Labour has formally
identified and passed on to the service provider to indicated that the revised OHS Act and Construction
draft and incorporate into the revised Practice Note Regulations will be signed and promulgated during

The Committee considered ways of measuring the

under the auspices of the Quality & Risk Management
Wallace Mayne
Committee, which requires all member firms to
complete and return a questionnaire together with Manager: Contractual Affairs

The CESA PI Scheme/Claims Triangle continued to
be presented by Aon at Committee meetings leading
to discussion of the premiums, number and value of
claims, types of claims and accordingly what training
courses need to be offered to minimise claims in that
category. In the year under review it was identified
that a large proportion of the claims were related
to structural failure requiring the development of
a suitable Practice Note and as well as a suitable
training course , focussing on the failure of software
and what safety checks need to be carried out.
The Committee initiated the tabling of the claims
triangle and explanatory notes at Board and Council
meetings, as this important information required
wider dissemination. Importantly Aon indicated that
owing to the downturn in the economy, the merging
of firms and the increased value of claims it was likely
that rates would harden in 2014
